BHP reported in January 2021 that any mine construction is expected to be several years away and will be subject to additional regulatory and government approvals, as well as stakeholder consultation, including with the relevant Native American tribes, to obtain consent.

Latest Developments
The Apache Stronghold filed a petition to the US Supreme Court in the quarter ended September 30, 2024, requesting it to hear its case to stop the land exchange between Resolution Copper and the federal government. 

A second petition was also filed by the San Carlos Apache Tribe with the US Supreme Court, in which it asks the court to review a decision by the Arizona Supreme Court regarding a water discharge permit issued to Resolution Copper by the state of Arizona. 

Rio Tinto continues to progress the final environmental-impact statement with the United States Forest Service, but it is yet to advise on the date of republication. 

The company has also advanced partnership discussions with federally recognised Native American tribes.
