Waste Legislation update
(Virtual Showroom): In November 2013 the Minister of the then Water and Environmental affairs promulgated GN 921 in terms of the waste act which contained the List of Waste Management Activities that have, or are likely to have, a detrimental effect on the environment.
On 11 October 2017, GN 1094 was published to amend the list of waste management activities that have, or are likely to have, a detrimental effect on the environment. In this list, the Category A activity (activities requiring a Basic Assessment Process to be followed) for: “(2) The sorting, shredding, grinding, crushing, screening or bailing of general waste at a facility that has an operational area in excess of 100m2” was removed or repealed and included in Category C. The requirements for a Category C activity were also amended to include compliance with the National Norms and Standards for the Sorting, Shredding, Grinding, Crushing, Screening or Baling of General Waste.
In February of 2022, GN 1757 was promulgated which further provides additional amendments to the list of waste management activities that have, or are likely to have, a detrimental effect on the environment and includes the determination of the commencement date for the National Norms and Standards for Organic Waste Composting and should be read in conjunction with GN 921 of 2013.
Additions are indicated in blue and removals striked through:
Category A
Activity 6: “The treatment of general waste using any form of treatment at a facility that has the capacity to process in excess of 10 tons but less than 100 tons per day calculated as a monthly average, excluding the treatment of organic waste using composting and any other organic waste treatment”
Activity 7: “The treatment of hazardous waste using any form of treatment at a facility that has the capacity to process in excess of 500 kg but less than 1 ton per day calculated as a monthly average, excluding the treatment of effluent, wastewater, sewage or organic waste using composting or any other organic waste treatment.”
Category B
Activity 4: “The treatment of hazardous waste using any form of treatment at a facility that process in excess of 1 ton per day calculated as a monthly average; using any form of treatment excluding the treatment of effluent, wastewater, or sewage or organic waste using composting or any other organic waste treatment.”
Activity 6: “The treatment of general waste using any form of treatment at a facility that has a capacity to process in excess of 100 tons per day calculated as a monthly average, excluding the treatment of organic waste using composting or any other organic waste treatment. using any form of treatment.”
Category C
Inclusion of the requirement for compliance with: National Norms and Standards for organic waste composting published under Government Notice No. 561 in Government Gazette 44762 of 25 June 2021.
Addition of Activity 7: “The treatment of organic waste using composting and any other organic waste treatment.”
