Hudbay settles long-standing Guatemala lawsuits
Toronto-listed miner Hudbay Minerals has reached a final settlement in three long-standing civil lawsuits brought against the company concerning alleged incidents in Guatemala in 2007 and 2009.
The legal matters, tied to Hudbay’s former ownership of the Fenix nickel project, have been settled without admission of liability, effectively closing the chapter on the company's involvement in the country.
The lawsuits, which included allegations of misconduct by the Guatemalan subsidiary managing the Fenix project, were brought against Hudbay following its acquisition of the project in 2008. One case involved 11 female plaintiffs, with allegations pre-dating Hudbay's ownership.
Hudbay divested its Guatemala assets in 2011 and has not operated in the country since.
“Hudbay is pleased to have reached a mutually agreed settlement that covers all three cases against the company. These matters have been outstanding for more than a decade, and the board and management at Hudbay are pleased to bring them to a conclusion,” said president and CEO Peter Kukielski.
“In doing so, we recognised the difficult economic and social circumstances of the plaintiffs and we are thankful for a constructive resolution with the plaintiffs and their counsel.”
The settlement was achieved without admission of liability, with both parties maintaining different perspectives on the facts underlying the allegations.
Hudbay underscored its commitment to responsible community engagement and adherence to human rights standards, reflected in its Human Rights Policy and its adherence to industry programmes such as the Mining Association of Canada’s Towards Sustainable Mining programme and the United Nations' Voluntary Principles on Security and Human Rights.
Private equity group Solway acquired the Fenix mine in 2011.
