Despite Mineral and Petroleum Resources Minister Gwede Mantashe gazetting a much-welcomed erratum to the controversial new Mineral Resources Development Bill on June 9, the Minerals Council South Africa is still not convinced the Bill is good for the industry.

Mantashe’s corrections effectively remove a contentious requirement for Ministerial consent on changes of control in listed companies, as well as eliminates the controversial empowerment clause relating to prospecting rights that had many in the industry up in arms.

While the Minerals Council said it had noted the gazetting of these two corrections, it maintained that the Bill was lacking.

“The Bill in its current form [still] does not encourage or sustain the growth and investment that the mining industry needs to realise its full potential to create employment, stimulate the economy and fulfil its social mandate,” the industry body said in a statement on June 11.

The Minerals Council said it would continue to review the Bill amending the Mineral and Petroleum Resources Development Act and that it would formally submit its comments by August 13.
